1. Scope
These Terms and Conditions (T&C) apply to all digital art commissions made between Spleeny (the “Artist”) and the Client.
By commissioning the Artist, the Client agrees to these terms.2. Work Process1. After acceptance of the commission, an estimated completion time will be provided.2. Depending on workload and project complexity, the completion time may take up to 6 months.3. Spleeny agrees to complete the artwork to the best of their ability within this timeframe.4. Delays caused by illness, technical issues, or force majeure will be communicated to the Client.3. Payment1. Payment is accepted via PayPal or Ko-fi, unless otherwise agreed.2. The commission will only begin once payment has been received.4. Cancellation and Refund Policy1. A commission may be cancelled at any time.2. If the commission is cancelled before any work begins (i.e., before any sketches are made), a full refund will be issued.3. If the commission is cancelled after work has begun (beyond the sketch phase), only 50% of the paid amount will be refunded.4. Once the artwork is completed, no refunds will be provided.5. Usage Rights1. Unless otherwise agreed, the Client receives a non-exclusive, non-transferable license for personal use only.2. Commercial use (e.g., for logos, products, or merchandise) requires separate written permission.3. Spleeny retains full copyright of the artwork and may use the finished piece (or parts of it) for portfolio, promotional, or social media purposes, unless the Client explicitly objects.6. Communication and Revisions1. The Client will receive progress updates or previews (e.g., sketches, color drafts) for approval.2. Minor revisions within the agreed stages are included.3. Major changes after the final approval may incur additional costs.7. Liability
Spleeny is not liable for any loss or damage caused by improper use, redistribution, or alteration of the digital artwork.8. Final Provisions1. German law shall apply.2. If any provision of these terms is found to be invalid, the remaining provisions shall remain in effect.3. Any changes or additions must be made in writing.
